Terms and Conditions

These Terms and Conditions apply to the use of onlyhomes.io, the OnlyHomes agent web app, public share pages, video packages, and enabled digital add-ons supplied by Ben Fiege CSM UG (haftungsbeschränkt). OnlyHomes is primarily intended for businesses, especially real estate agents and commercial property marketers. Consumers as defined by Section 13 of the German Civil Code may also use OnlyHomes where access or a purchase is offered to them. Mandatory consumer rights, including cancellation rights, remain unaffected.

OnlyHomes provides a web app for creating property projects, uploading property data and images, and automatically generating property videos. Depending on the available feature set, completed videos may be downloaded, shared on public property pages, and published to connected external platforms. Share pages may contain property and agent information, calls to action, performance statistics, and inquiry forms. OnlyHomes does not promise a sale, a particular number of leads, or a particular reach.

An account is required to use the agent web app. Users must provide complete and accurate information and keep credentials confidential. Login may be available by email and password or through Google. Google's terms additionally apply to a Google account. Users are responsible for activity attributable to them and must promptly report suspected misuse or unauthorized access.

The presentation of packages and add-ons is not a binding offer. The user selects a product, confirms the required information and declarations, and proceeds to Stripe Checkout. Completing Stripe Checkout constitutes a binding order. The contract is formed when OnlyHomes confirms the purchase or activates the purchased credit or add-on in the account. Input errors can be corrected before payment. Order information and the legal terms applicable at formation are provided on a durable medium, generally by email.

One first successfully rendered property video may be provided free of charge per agent account. The free video is used only after a successful render; failed renders do not consume it. OnlyHomes may use technical safeguards against duplicate registrations, circumvention, or misuse.

After the free first video, users may purchase one-time video packages: - Listing: 2 videos for EUR 30.00. - Business: 10 videos for EUR 150.00. - Professional: 30 videos for EUR 450.00. All prices are gross prices including statutory VAT. The price shown in Stripe Checkout at the time of purchase is decisive.

Purchased video packages are added to the account as credits and permit the corresponding number of successful property videos. Purchased credits expire 12 months after the respective purchase date if not used. Cash payout, transfer to another account, or conversion into other services is excluded to the extent permitted by law.

A credit is generally consumed when a property video has been created successfully. Failed renders do not finally consume a credit. A credit may be reserved while a render job is active and is released again if the job is not completed successfully.

Payments are processed by Stripe. Users are redirected to Stripe Checkout, and invoices, payment status, and payment information may be managed through Stripe and its customer portal where available. OnlyHomes does not store complete card or bank details. Stripe's terms and privacy notices also apply to payment processing.

Consumers generally have a statutory 14-day cancellation right for distance contracts. Details are provided during checkout, with the contract confirmation, and at https://www.onlyhomes.io/widerruf. For digital content not supplied on a tangible medium, the right may expire when performance begins if all statutory requirements are met. For services, the right generally expires only after the service has been fully performed. In particular, the consumer must expressly request or consent to performance before the cancellation period ends, acknowledge the statutory consequences, and receive the required confirmation. Until those requirements are met, statutory consumer rights remain unaffected.

Once a property video has been successfully created and the corresponding credit has been consumed in accordance with the contract, the credit is not restored merely because the result does not match a user's subjective stylistic preference. Statutory rights, including cancellation, warranty, price reduction, and damages rights, remain unaffected.

Users must not misuse OnlyHomes or upload or publish unlawful content or content that infringes third-party rights, including copyright, trademark, personality, data protection, or competition law. Users must hold the necessary rights to all images, text, logos, property data, and links, and are responsible for the accuracy, currency, and legality of property and contact information.

Users grant OnlyHomes the rights required to provide the agreed services, including storing and processing uploaded material, incorporating it into videos, providing share pages, and enabling downloads. Users may use completed videos for their own property marketing. OnlyHomes may not freely use uploaded content for its own advertising or unrelated purposes without a separate agreement or consent.

If an optional studio or background-removal feature is offered, the selected image may be transmitted to an image-processing provider only after the user expressly chooses that function. Automated editing may produce inaccuracies or artifacts. Users must review the result before publication and must not use it where it misleadingly depicts the property or its condition.

Public share pages may be accessible to anyone. The user controls which property and agent information is published or stored in the profile. Inquiries submitted through a share page are shown in the relevant agent account. OnlyHomes does not guarantee that an inquiry will result in a sale, lease, viewing, or other transaction.

OnlyHomes may enable direct publication of completed videos to connected TikTok, YouTube, Facebook, or Instagram accounts. Publishing occurs only after the user has connected the platform account, selected the video and destination, and confirmed that specific publication. Users are responsible for titles, descriptions, visibility, advertising and AI labels, rights in the content, and compliance with platform rules. Platform providers may reject, delay, restrict, or remove uploads and may change their interfaces or terms. Disconnecting an account prevents future publishing through OnlyHomes but does not delete existing platform posts, which must be managed with the platform provider.

OnlyHomes aims to provide a stable and secure service but does not guarantee uninterrupted availability. Maintenance, security measures, updates, provider outages, or force majeure may cause limitations. Features may be developed, changed, or replaced provided the agreed principal service is not materially impaired.

OnlyHomes may temporarily suspend accounts or content where there are concrete indications of misuse, fraud, unlawful content, missing content rights, attacks, circumvention of safeguards, payment fraud, or other serious violations. Termination for cause remains available. Users may request account termination or deletion through the web app or at support@onlyhomes.io. Mandatory retention, open contracts, payments, and claims remain unaffected. Users should download materials they still need before deletion.

Statutory warranty rights apply. Statutory inspection and notice duties apply to businesses where relevant. Subjective expectations about style, reach, sales, or lead volume do not constitute a defect where the agreed technical service has been properly supplied.

OnlyHomes is liable without limitation for intent and gross negligence, injury to life, body, or health, and under mandatory law. For slightly negligent breach of an essential contractual duty, liability is limited to the foreseeable damage typical for the contract. Otherwise liability is excluded to the extent permitted by law. In particular, OnlyHomes is not liable for missing sales or leads, inaccurate user information, unlawful user content, or disruptions outside its control.

The user indemnifies OnlyHomes against third-party claims arising from unlawful use of the platform, user-provided content, or a breach of these Terms for which the user is responsible, including reasonable defense costs.

OnlyHomes may amend these Terms for an objective reason where the change is reasonable for users. Material changes will be communicated appropriately. A purchase is generally governed by the version in effect at the time of that purchase.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection under the law of their habitual residence. Berlin is the venue for merchants, legal entities under public law, and public-law special funds.

Ben Fiege CSM UG (haftungsbeschränkt) is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

If an individual provision is or becomes invalid, the remaining provisions remain effective. The statutory provision applies in place of the invalid provision.
